The website www.mycruiseship.info (the “Website”) is a business-to-business website and is owned and operated by mbit-web.com, Alsgasse 10, 1170 Vienna (“MYCS”).

The Website is principally intended for use by the maritime community as a sectoral index tool for finding

  • information about suppliers to the maritime industry and their products as well as
  • recruitment agencies and their offered personnel and
  • cruise lines and their cruise ships

(together the “Content”).

These terms and conditions (the “T&C”) govern the relationship between MYCS and visitors who browse the Website and want to use the Content (the “Visitor”).

The legal relationship between MYCS and those business entities who want to offer Content to Visitors and therefore provide respective data for the supply, management, maintenance and verification of Content, such as information, art work, advertising, logos or photographs or any other material (the “Client”), is governed by separate “Conditions of Service” and “Service Guidelines”.

Scope of the T&C
The legal relationship between a Visitor and MYCS is governed exclusively by the T&C, irrespective of any special or general terms provided by a Visitor.
MYCS may change the T&C at any time without any notice. By the continued use of the Website, the Visitor agrees to be bound by the most current version of the T&C.
In case that a Visitor is or becomes also a customer for products and services offered by MYCS other than the Website (in particular the sectoral index), the T&C shall only apply to the use of the Website. Any other legal relationships with MYCS shall be governed by a respective user or service agreement, respective terms & conditions or any other agreement that applies to a particular product or service which is offered by MYCS.
Use of the Website
A Visitor may access the Website, make copies of the results of any searches he has conducted, and use those results for any reasonable purpose within the Visitor’s business, except for those set out below.
The Visitor shall not, under any circumstances (whereas the term “Content” also includes parts of the Content or the parts of the information provided under the Content):
  • Modify the Content or any other material available on the Website or adapt, change, amend or merge the aforementioned with any other data;
  • Provide and/or offer the Content to a third party or otherwise trade in the material copied from the Content;
  • Use the content for any unlawful, offensive, abusive, indecent, obscene or menacing purposes or any purpose that is likely to bring MYCS and/or the Website into discredit or to cause MYCS embarrassment;
  • Resell, republish, rebrand, reuse, relicense, sub-license or redistribute the Content for the purposes of (i) compiling databases, (ii) lists, (iv) directories, or (v) any other comparable form of structured information;
  • Use and/or provide the Content or the results obtained from the Content as a source for the production or the facilitation of the production of targeting material or contact data for any kind of telemarketing, direct marketing, viral or other elec-tronic marketing activities;
  • Permit or allow the results obtained on the Website to infringe or otherwise prejudice the proprietary rights of MYCS or any other third party.
  • Conduct any measure or action which can be qualified as preparatory to any of the prohibited measures referred to in the points above.
Website and Content
The Website, the Content and the services each are provided on a basis "as is" and "as and when available".
It is expressly acknowledged and agreed that MYCS, with regard to the Website, the Content and the services will not warrant or represent or guarantee their suitability, ongoing availability, accuracy, freedom from fault, freedom from viruses, worms, malware or other impairing or harmful components (such as malware, including worms, trojans or the like) or any fitness for any particular purpose.
However, MYCS will use reasonable efforts in the creation and maintenance of the Website (to this regard, this may include the whole or partly suspension of the operation of the Website and Visitor may not obtain any rights from such suspension). To this respect, MYCS will:
  • will use commercially reasonable efforts in order to ensure that the Website, the Content and the services run free of faults (Visitor undertakes to inform MYCS of any error of fault or malware he may detect when using the Website, using the contact form on the Website);
  • use commercially reasonable efforts to keep the Content and information available on the Website as accurate as possible, whereas the Visitor acknowledges that the accuracy of the provided Content depends primarily on the information provided by the Clients. MYCS merely provides a directory of the Content with search functions and thus will not assume any liability for inaccuracies or errors of the Content or information provided by any third party on the Website. The Parties expressly agree in this context that MYCS is not an agent or representative for any third party, in particular not for Clients, and therefore under no circumstances represents, warrants or vouches for the provided Content, its availability, suitability or the prices of the wares and services offered under the Content. Neither does MYCS represent, warrant, vouch or assume any liability for the legal entitlement, competences, professional qualifications, and certifications, memberships of trade associations of third parties that are offering Content or any other form of information on the Website. The respective legal relationship governing the purchase of Content between a Visitor and a Client does not create any obligations of MYCS.
Neither MYCS nor any of its agents, content providers, Clients, sponsors or licensors make any representation or warranty or condition, either express or implied, statutory or otherwise, to the Visitor as to the accuracy, content, timeliness, completeness, non-infringement of proprietary rights, intellectual property rights or otherwise, legality, reliability, merchantability, fitness for a particular purpose, quality or suitability of any information, advice, Content, service, search results, products, services, goods or merchandise, provided through, advertised on, received through links provided on, or in connection with the use of the Website.
The Visitor acknowledges that no oral or written information or advice given by MYCS or its affiliates, or any of its officers, directors, employees, agents, Clients, merchants, sponsors, licensors, or the like, will create a representation, a warranty or a guarantee on behalf of MYCS.
Intellectual Property (IP)
For the purpose of the T&C, the term “IP” shall include any intellectual property rights, including, without limitation, trademarks, design rights, industrial design rights, copyrights and database rights in the information displayed on the Website and in particular also on the search results after having conducted a search of the Content on the Website.
Unless otherwise stated and to the extent permitted under applicable law, MYCS and its respective licensors own all intellectual property rights related to the Content of the Website (including but not limited to: designs, texts, graphics, the arrangement and combination of the aforementioned) and in the software used therein.
The Visitor hereby expressly acknowledges that the use of the search results obtained from the Content during a search is also subject to any applicable third party rights and licenses.
Nothing contained in the T&C or anywhere on the Website shall be construed as conferring any licence or other right of use under any of MYCS’s or any third party's IP. MYCS reserves all rights of ownership in the IP, including (but not limited to) all offers and concepts available on the Website. They may not be made accessible to third parties.
The term “mycruiseship.info” as well as related terms containing “mycruise­ship” are service marks of MYCS. All other trademarks, product names and company names or logos cited anywhere on the Website are the property of their respective owners.
Miscellaneous
This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof. Except as expressly provided herein, all prior agreements or understandings, if any, between the Parties with respect to the subject matter hereof shall, upon the execution of this Agreement, be null and void.
Any notice under this Agreement may be sent by letter, fax or e-mail to the Administrator of the Client or to MYCS’s customer support (details may be found on the contact page of www.mycruiseship.info).
No waiver by any party, whether express or implied, of its rights under any provision of this Agreement shall constitute a waiver of the party’s rights under such provisions at any other time or a waiver of the party’s rights under any other provision of this Agreement. No failure by any party to take any action against any breach of this Agreement or default by another party shall constitute a waiver of the former party’s right to enforce any provision of this Agreement or to take action against such breach or default or any subsequent breach or default by the other party. To be effective any waiver must be in writing and signed by the waiving party.
In the event that a provision of these Conditions of Service is or becomes, in whole or in part, ineffective or impracticable, the effectiveness or practicability of the remaining provisions shall not be affected. The ineffective or impracticable provision shall be isolated from the remaining provisions while maintaining their respective validity.
By agreeing to MYCS’s Terms of Use, You acknowledge and consent that MYCS may use information as set out in these Terms of Use and the Privacy Policy, and any other information you later provide. MYCS may also, as part of our services, use and make available your information to current and potential users of MYCS, in addition to information about the supplier web pages on MYCS you have visited, what searches you have done, and other usage information, unless you change your Pages settings to opt out.
Any deviation from these T&C requires the written approval of MYCS in order to be effective.
Jurisdiction and governing law
These conditions shall be governed by and construed in accordance with the laws of Austria.
Any dispute, controversy or claim arising out of or relating to this Agreement, or the breach, termination or invalidity thereof, shall be exclusively settled by before the competent court in Eisenstadt.
MYCS controls the Website from within the country of Austria. It can, however, be accessed from other places around the world. Although these places may have different laws from those of Austria, by accessing the Website, the Visitor agrees that the laws of Austria, without regard to rules relating to conflict of laws, will apply to all matters relating to the use of the Website.
Should a Visitor access the Website from outside of Austria, he acknowledges that he does so voluntarily and under the responsibility of complying with all local laws.
Limitation of Liability
To the extent permitted by law, the liability of MYCS shall only apply to wilful and gross negligent misconduct.
The compensation of consequential damages, pure pecuniary losses, lost profit, loss of interest and of damages resulting shall be excluded.
MYCS shall not be liable for minor deviations and/or interruptions on the Website.
Furthermore, MYCS shall not be liable for damages resulting directly or indirectly from Content that has been provided by Clients, improper handling, wilful damaging, negligence, or unauthorised changes made by a Client to his respective listing on the Website.
MYC not warrants for any faults and assumes no liability for damages resulting from a faulty installation or use, misuse, negligence or for other reasons than the normal use of the Website.
The liability restrictions set forth in this article shall also apply to the legal representatives, employees and authorised agents of MYCS.
Conditions of Service

The Website is principally intended for use by the maritime community as a sectoral index tool for finding information about

  • suppliers to the maritime industry and their products as well as
  • recruitment agencies and their offered personnel and
  • cruise lines and their cruise ships

(together the “Content”).

The legal relationship between MYCS and those business entities who want to offer Content to Visitors via the Website and therefore provide data for the supply, management, mainte-nance and verification of Content, such as information, art work, advertising, logos or photo-graphs or any other material (the “Clients”), is governed by these Conditions of Service.

Separate terms and conditions govern the relationship between MYCS and those who browse the site and make use of such Content (the “Visitors”).

Scope of the Conditions of Service
The legal relationship between a Client and MYCS is governed exclusively by (i) these Conditions of Service, (ii) any order form accepted by MYCS, (iii) the applicable service descriptions on the Website applying to the services to a Client (see Packages), and (iv) the Service Guidelines, each irrespective of any special or general terms provided, used, or declared to be used by a Client.
MYCS will enter into a business relationship with a Client only on the basis of these Conditions of Service. The Conditions of Service thus become binding as soon as a Client accepts them on order forms, in the course of registration / verification proc-esses or in any other form. Furthermore, it is understood that these Conditions of Service shall apply from the moment on that a Client is ordering and/or using one of the Services.
MYCS is not obliged to provide any of the Services to a (prospective) Client or to en-ter into a contractual relationship with such person. It lies within the sole discretion of MYCS whether or not to enter into a contractual relationship with a Client (such deci-sion will depend, in particular, on the assessment whether Client is operating a busi-ness appropriate for the Website).
In case that a Client is or becomes also a customer for other products and services offered by MYCS, the Conditions of Service shall only apply to the provision of the Services by MYCS. Any other legal relationships with MYCS shall be governed by a respective user or service agreement, respective terms & conditions (such as the Terms and Conditions for the use of the Website) or any other agreement that applies to a particular product or service which is offered by MYCS.
MYCS may change, amend, or reissue the Conditions of Service at any time. In order to become effective, such change has to be notified to the Client (via E-Mail to the competent administrator or comparable person in charge) with a notice period of 14 days. Any envisaged changes of the Conditions of Service will also be notified on the Website. By the continued use of the Services without raising an objection to an en-visaged change within the notice period, the Client agrees to accept the envisaged changes and to be bound by the Conditions of Service in their most current version. In case a Client objects to an envisaged change of the Conditions of Service, MYCS has the right to terminate the legal relationship with such Client with immediate effect.
The Services
MYCS offers the services to the Clients as they are specified in the Service Guide-lines and on the applicable service descriptions available on the Website (see Packages) (hereinafter the “Services”).
MYCS may use agents and/or sub-contractors to perform, or assist it in performing, Services on its behalf, should this be deemed appropriate or necessary by MYCS.
In case that the Client has to provide any information, data or other service in order to enable MYCS to perform its Services for such Client (the “necessary Services”), MYCS shall not be obliged to perform any Services or preparatory works until all nec-essary Services have been duly performed and/or delivered. Any content provided to MYCS in the course of necessary Services is not required to be returned to the re-spective Client.
Whereas MYCS shall use commercially reasonable efforts to improve and maintain the functionality of the Website, it remains within the free and sole discretion of MYCS to alter the look, design, style, infrastructure, environment, facilities, and functionality of the Website and the Services offered on the Website, without giving prior notice to the Client. To this respect, the parties acknowledge that MYCS may also remove a Service or a material part of a Service from the Website without providing a respec-tive substitute. MYCS will use reasonable efforts to inform a Client who uses a Ser-vice that shall be removed (e.g. via E-Mail to the competent administrator or compa-rable person in charge) within a notice period of 14 days before the removal of such Service. Any envisaged removals of Services will also be notified on the Website. A Client who has been using a removed Service shall be entitled to a refund of the funds paid for the period in which such removed Service was not available.
Remuneration
MYCS may offer some of its Services at certain times free of charge to certain or all Clients. Notwithstanding the foregoing, however, MYCS shall be entitled to charge a fee for its Services (the “Fee”) (this right also applies to Services which have been provided at a certain time free of charge).
The Fees payable for certain Services are set out and described in Packages and in the respective order form (including possible applicable taxes such as VAT).
Unless otherwise expressly agreed in writing between the parties, the Fee shall be paid as follows:
  • If the respective Service is provided on a periodic basis, the Fee shall be payable at the time of the order for the first period and again on each start of a subsequent payable period.
  • Fees for pre-ordered Services shall be payable at the time the pre-order is placed.
  • If the respective Service is provided as a one-time service, the Fee shall be pay-able at the time of the order.
  • Add-ons to Professional Packages shall be charged aliquot to the remaining duration of the professional package.
MYCS reserves the right to change the Fees at any time. MYCS will use commercially reasonable efforts to inform the Client (e.g. via E-Mail to the competent administrator or comparable person in charge) of an envisaged change of the Fees within a notice period of 14 days. Any envisaged changes of the Fees will also be notified on the Website. The change of a Fee will only apply to future Services (e.g. in case of periodic Services, a changed Fee shall apply from the start of the subsequent payable period).
The Client expressly acknowledges that the continued use of Services for which the Fees have changed constitutes an acceptance of such change.
Responsibilities of the Client
Client hereby warrants, represents and guarantees that the following facts and state-ments are true:
  • The Client has obtained all rights, authorities, permissions and consents to enter into an Agreement with MYCS and the Administrator employed by Client has the powers to act on behalf of Client (whereas “Administrator” is the person who has control of the e-mail address and any other details and is designated as “Directory Listing Admin” on the contact page of the Client’s listing on the Website).
  • Client will, for the duration of this agreement, at all times keep the details of his Administrator updated so that Client can at all times be reached and contacted via the contact details published on his respective listing on the Website.
The Client confirms that he is authorised to access the Website and the services of-fered only for the purpose of managing and maintaining as well as updating its re-spective account and its services offered to the Visitors. The Client confirms that he, at no time, will acquire any other rights or licences with regard to the Website.
The Client hereby confirms that he will abide at all times with these Conditions of Service.
The Client hereby warrants, represents and guarantees that the following facts and statements are true with respect to the Content, which will be provided by the Client for publication on the Website:
  • The Content will be held accurate, complete, up-to-date and honest;
  • The Content will be provided in a suitable format free of any viruses, worms, trojans and any other form of malware;
  • The Content does not infringe or breach any applicable laws and/or regulations as they are amended from time to time, in particular laws regarding the advertisement, sale or marketing of wares and services, also including ethic codes for advertising standards issued by self-regulatory bodies or comparable rules;
  • At no time, the Content will be indecent, offensive, prejudicial, inflammatory, defamatory, blasphemous or racially and or sexually abusive;
  • The Content will at no time expose MYCS to any form of claims from third parties, which could lead to a prosecution of MYCS or could cause it public embarrassment or distress in any form. The Client hereby guarantees to hold MYCS harmless of and indemnify against any and all claims from third parties raised in connection with the publication of Content provided by such Client on the Website;
  • The Content does not violate or breach any law, statute, regulation, rule or decision from a court or administrative body in any relevant jurisdiction;
  • The intellectual property used by Client for the creation of the Content is the property of the Client or has been validly been licensed to Client in a way that permits the use on the Website. The Client has the right and/or authorisation to grant MYCS the right to hold, reproduce, publish, adapt, transmit and disclose the provided Content;
  • The Content does not at any time or in any manner infringe any copyright, design right, database right, patent, trade mark, trade secret or any other intellectual property or proprietary rights (whether registered or unregistered) of any third party or any rights and forms of protection of a similar nature to any of the foregoing or having equivalent effect anywhere in the world. On MYCS’s request, the Client shall provide MYCS with suitable documentary evidence that will reasonably satisfy MYCSof Client’s entitlement to make use of any of the Content provided or to make enquiries to a third party as to Client’s entitlement to use the provided Content.
Without prior express written approval, the Client shall not:
  • interfere or attempt to interfere with the operation or the functionality of the Website and/or the Services;
  • copy, license, sub-license, distribute, sell, or publish any of the Content of the Website;
  • grant or allow access to the Website or the Services to any person other than such persons which have been admitted as administrators;
  • use the Website and the Services or the Content for any other purposes than those expressly permitted by MYCS;
  • resell any service which Client has purchased or is entitled to use to a third party.
In case of a violation of a provision of one the above mentioned clauses by a Client, MYCS reserves its right to remove any and all Content, listings, advertising or other materials provided by such Client. Notwithstanding the foregoing, the Client shall indemnify, defend and hold harmless MYCS for any liability, claims, damages and costs, including cost for legal representation, arising out of or in connection with a violation of his obligations, representations and warranties under this Agreement.
The Parties acknowledge that MYCS will fully co-operate with any investigations of violations of systems or security networks or security at other sites and with law enforcement authorities in the investigations of possible criminal violations related to the Website, should such investigations be commenced. If a Client violates any systems and/or network security, such Client may also incur other criminal or civil liability. The Client however shall not be liable if the performance of his obligations under this agreement is hindered by an event of force majeure (e.g. civil disorder, war, military operations, national emergencies and the like).
Responsibilities of MYCS
The Website and the Services each are provided on a basis "as is" and "as and when available".
It is expressly acknowledged and agreed that MYCS, with regard to the Website and the Services will not warrant or represent or guarantee their suitability, ongoing availability, accuracy, freedom from fault, freedom from viruses or other impairing or harmful components (such as malware, including worms, trojans or the like) or any fitness for any particular purpose.
However, MYCS will use reasonable skill and care in the creation and supply of the Website (to this regard, this may include the whole or partly suspension of the operation of the Website and Client may not obtain any rights from such suspension. However, MYCS undertakes to inform the client in advance of an envisaged suspension). To this respect, MYCS will:
  • will use commercially reasonable efforts in order to ensure that the Website, the Content and the services run free of faults (Visitor undertakes to inform MYCS of any error of fault or malware he may detect when using the Website, using the contact form on the Website);
  • use commercially reasonable efforts to keep the Content and information provided by Client on the Website as accurate as possible, whereas the Client acknowledges that the accuracy of the provided Content depends primarily on the information provided by him. MYCS merely provides a directory of the Content with search functions and thus will not assume any liability for inaccuracies or errors of the Content or information provided by any third party on the Website. The Parties expressly agree in this context that MYCS is not an agent or representative for the Client, and therefore under no circumstances represents, warrants or vouches for the provided Content, its availability, suitability or the prices of the commodities and services offered under the Content. Neither does MYCS represent, warrant, vouch or assume any liability for the legal entitlement, competences, professional qualifications, trade certifications, memberships of trade associations of the Client the Website. The respective legal relationship governing the purchase of Content between a Visitor and a Client does not create any obligations of MYCS.

The liability restrictions set forth in this article shall also apply to the legal representatives, employees and authorised agents of MYCS.
Duration and Termination
In case MYCS provides a Service on a periodic basis, such Service is provided from the first date payment of Client until the end of the agreed period (or, as the case may be, until any other date agreed between the parties). The renewal of such Service immediately takes effect after receipt of the Client’s payment.
A premature termination of Services is not envisioned.

In case that MYCS provides a Service on a one-time basis, this Agreement shall terminate upon the later of (i) performance of such Service by MYCS and (ii) receipt of payment in cleared funds from Client of all Fees that are due in relation to such Service.
Notwithstanding the above, each Party may terminate this Agreement with immediate effect for good cause, if the other Party is in breach of its obligations under this Agreement.
Place of Performance, Applicable Law, Venue
The Place of performance is Eisenstadt.

This Agreement shall be governed by Austrian law.

Any dispute, controversy or claim arising out of or relating to this Agreement, or the breach, termination or invalidity thereof, shall be exclusively settled by before the competent court in Eisenstadt.
Miscellaneous
This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof. Except as expressly provided herein, all prior agreements or understandings, if any, between the Parties with respect to the subject matter hereof shall, upon the execution of this Agreement, be null and void.
The assignment of a Client’s rights or obligations arising out of this Agreement shall only be permitted upon prior written approval by MYCS.
Any notice under this Agreement may be sent by letter, fax or e-mail to the Administrator of the Client or to MYCS’s customer support (details may be found on the contact page of www.mycruiseship.info).
No waiver by any party, whether express or implied, of its rights under any provision of this Agreement shall constitute a waiver of the party’s rights under such provisions at any other time or a waiver of the party’s rights under any other provision of this Agreement. No failure by any party to take any action against any breach of this Agreement or default by another party shall constitute a waiver of the former party’s right to enforce any provision of this Agreement or to take action against such breach or default or any subsequent breach or default by the other party. To be effective any waiver must be in writing and signed by the waiving party.
In the event that a provision of these Conditions of Service is or becomes, in whole or in part, ineffective or impracticable, the effectiveness or practicability of the remaining provisions shall not be affected. The ineffective or impracticable provision shall be isolated from the remaining provisions while maintaining their respective validity.
Any deviation from these T&C requires the written approval of MYCS in order to be effective.
Service Guidelines

These guidelines (the “Service Guidelines”) represent good industry practice and will be further developed based on the experience of mycruiseship.info (“MYCS”).

Unless expressly stated otherwise, the terms in capital letters used in the Service Guidelines shall have the same meaning as they have in the Conditions of Service and the T&C.

Information

The use of the word “Information" in these Service Guidelines shall mean all information, data, art work, advertising, logos or photographs or any other material that a respective Client provides to MYCS in order to offer his products and services to Visitors via the Website.

Services

MYCS currently offers the following services to Clients (the “Services”):

  • a Listing, meaning the details of the Client’s business, publicly made available to Visitors, which the Client can create, verify, amend, update, or extend through purchasing the right to add extra Content;
  • Job candidate profiles posted by Recruitment Agencies
  • Job candidate profiles posted by individuals
  • Advertising the products and services provided by the Client to the Visitors.

The various levels and types of Listing and Advertisement are described in the Packages section.

Legal
Reference is made to the Conditions of Service and in particular to representations and warranties of the Client with regard to the Information / Content provided to MYCS.
The Client acknowledges that the responsibility of compliance with applicable local and international laws and requirements with respect to the Information and the Content lies solely with him. The Client expressly confirms in this context that he is aware that the Website is available in numerous countries around the world and that Visitors, who are potential customers, have their seat in numerous countries around the world. It is the Client’s obligation to ensure that the Information and Content provided by him is in compliance with all applicable laws and regulations.
It lies within the sole discretion of MYCS to reject any Information or Content which it considers to be in breach of a provision of the Conditions of Service or the Service Guidelines.
In case MYCS does not reject any Information or Content, this does not, however, in any way affect a possible liability of the Client to MYCS and his respective obligations to this regard, as they are set forth in the Conditions of Service.
Natural Persons

A Client may only be listed on the site if he is a validly existing, registered company; except for Job Seekers mentioned in Content, the Website is at the moment not open to natural persons. Please contact MYCS for further information.

Listing Guidelines
  • The Information and Content provided by a Client must be accurate and not misleading. Thus, in particular the following criteria have to be fulfilled:
  • A reference to "Memberships" means that a Client is properly registered as a member of any organisation that he is listed under this section;
  • A reference to “Certificates” means that the Client is an authorized holder of a certificate issued by the respective certification organization;
  • A reference to "Supply Categories" means that the Client is a regular supplier of the category of items listed under this section or that the Client can obtain the items easily within the expectations of the average customer;
  • A reference to "Ports served" means that a Client, while not being physically present in such ports, the Client delivers orders to such ports regularly and is capable of doing so easily within the expectations of the average customer;
  • The Client shall not use any intellectual property, such as logos, trademarks or brand styles / look and feel of a third person unless he has obtained a respective license and/or authorisation to do so;
  • Suggesting to offer the lowest prices or the best product is not permitted unless the Client has sufficient evidence to prove these facts;
  • Offensive or other inappropriate language is not permitted;
  • URLs must connect to the front page of the Client’s website or the main subsection that deals with the maritime activities. Such page must not generate pop-ups when Visitors enter or leave it;
  • Should a Client offer discounts or Free offers in any Content, a Visitor should be able to find the information related to such offers within a maximum of 3 clicks on.
Display of the Listing

The following guidelines should be followed when completing the Client’s listing:

  • Whole words should not be capitalised for emphasis. Capitals should only be use as in normal sentences.
  • Punctuation should be used. The use of exclamation or question marks is not appropriate in a listing.
  • Correct spelling should be used.
  • Unnecessary repetition is not permitted
  • Telephone numbers must be shown as: International access code - City code (without any initial 0 e.g. +00-000-0000000).
  • Contact E-Mails should be lowercase
  • Contact last names should be uppercase to facilitate distinction between first and last name

MYCS reserves the right to amend the Content offered by a Client in order to preserve adherence to the Service Guidelines and the Client confirms and acknowledges such right.

Restrictions on offered products and services
Content involving the mention of individual brands of the following product types is not allowed on the Website (however, the advertising of the ability to supply such product groups is allowed, under the condition that this is not in breach with any applicable laws):
  • Alcohol
  • Drugs, medicines, drug accessories, herbal remedies prescription or otherwise
  • Tobacco products, cigarettes, cigars, pipe tobacco etc.
Content involving the offer of the following products and services is not permitted in any form:
  • Counterfeit goods or replicas e.g. spare parts
  • Fake documents e.g. fake IDs, passports, diplomas, certificates etc.
  • Gambling - casinos, betting, bingo, gaming whether on-line or off-line
  • Sexual services including prostitution, pornography etc.
  • Any kind of weapons such as firearms, ammunition, knives (other than for normal shipboard use), brass knuckles or similar offensive weapons.
Furthermore, the Client’s website must not offer or promote any of products or services mentioned in section 7.2.
Should a Client offer professional services (e.g. medical, legal etc.), he has to ensure that he is at all times authorised to carry out such services and the respective Content must comply at all times with any applicable professional services laws and regulations in respect to any listing or advertisement within the meaning of such laws and regulations.
Breaches
If a Client or other third party believes that any Information or Content contained the Website is in breach of the Service Guideline, an e-mail should be sent to  Contact stating the nature of the breach.
If MYCS has reason to believe that a Client is in breach of the Service Guidelines, it will inform the Client of the nature of the breach and specify the actions required to rectify such breach. Depending on the nature of the breach, MYCS will give the Client a maximum grace period of seven days to rectify the breach or to provide an explanation satisfactory to MYCS why no breach has occurred.
Should the Client fail to rectify the breach or provide a satisfactory explanation for the non-existence of a breach, MYCS shall be entitled to carry out all measures necessary for a rectification.
If, in MYCS’s opinion, it should not possible or appropriate to give the Client a grace period for rectification, MYCS shall have the right to carry out the required measures for rectification immediately, but will notify the Client as soon as possible thereafter.
Should the Client reverse or amend any measures which have been undertaken to rectify breach without consent of MYCS, Client shall be considered to be in severe breach of the Conditions of Service and MYCS shall have the right to terminate the respective listing of the Client in accordance the provisions of the Conditions of Service. In such cases no refund of any fees shall be payable to the Client.
Changes
MYCS may at any time change, amend, replace or delete these Service Guidelines.
Before any proposed change becomes effective, MYCS shall use reasonable efforts to e-mail the Administrator of the Client under a notice period of 14 days. Such changes shall also be notified on the Website.
